Criminal law counteraction to the unauthorized dissemination of military information in Ukraine

The dissertation is a comprehensive scientific study aimed at solving such an important scientific and applied problem as the substantiation of theoretical provisions and the development of directions for improving the domestic criminal law and the practice of its application, aimed at increasing the effectiveness of criminal legal counteraction to the unauthorized dissemination of military information in Ukraine.
Chapter 1 "Social conditionality of the criminalization of the unauthorized dissemination of military information" was devoted to a consistent description of the grounds, reasons and principles of the criminalization of acts provided for in Art. 114-2 of the Criminal Code of Ukraine.
Chapter 2 "Objective signs of the composition of crimes provided for in Art. 114-2 of the Criminal Code of Ukraine" consists of two subdivisions.
In particular, in subsection 2.1 of the work, the generic object of crimes against the foundations of national security of Ukraine, the main and additional direct objects of the composition of crimes, provided for in Art. 114-2 of the Criminal Code of Ukraine, as well as their subject. The legitimacy of the legislator’s decision to recognize the act in question as a kind of encroachment on the foundations of Ukraine’s national security, which is a systematic step that best reflects the anti-social orientation of the unauthorized dissemination of military information, has been proven.
Subsection 2.2 highlighted the features of the objective side of the investigated torts. In particular, it has been proven that the mentioned in Art. 114-2 of the Criminal Code of Ukraine, the concept of "dissemination" includes not only public and "primary", but also non-public and "secondary" communication of relevant information to an indefinite number of persons.
Chapter 3 "Subjective features of the composition of crimes provided for in Art. 114-2 of the Criminal Code of Ukraine" was dedicated to the consistent characteristics of the subject and the subjective side of the analyzed crimes.
