Legal Support for environmental Security in martial Law

Abstract

The dissertation is a comprehensive study of the legal framework for environmental safety under martial law.
Chapter 1, “General Theoretical Foundations for Ensuring Environmental Security under Martial Law,” summarizes the legislative and doctrinal approaches to understanding the concepts of “environmental security” and “environmental security system,” and identifies the components of the legal framework for ensuring environmental security under martial law; and the legal foundations for ensuring environmental security in the European Union are analyzed.
Chapter 2, “Organizational Framework for Environmental Safety under Martial Law,” identifies the correlation between the categories “entities responsible for ensuring environmental safety” and “entities related to environmental safety”; approaches to defining the concept of “environmental safety management” are analyzed and summarized, and the specific features of environmental safety management under martial law are identified; based on an analysis of the practice of the European Court of Human Rights (ECHR), the state’s obligations regarding the assurance of environmental safety in the context of armed conflict are identified.
Chapter 3, “Legal Liability in the System of Environmental Safety under Martial Law,” clarifies the concepts and defining characteristics of legal liability in the field of environmental safety; it describes the specific features and grounds for civil liability for environmental damage caused under martial law; and it identifies the specific features of criminal law protection of the environment and liability for environmental criminal offenses in the context of armed conflict.
