The thesis is dedicated to a comprehensive study of the legal issues surrounding the application of analogy in commercial litigation.
In the 1st Section “Theoretical foundations of the application of the institution of analogy in commercial procedure” the author argues that modern commercial life is highly dynamic, characterized by the constant emergence of new commercial relationships, while legislative regulation often lags behind practical needs. In these conditions, legal analogy serves as a tool to balance the promotion of innovation with the stability and consistency of legal regulation.
In the 2nd Section “Conditions and limits of the application of the institution of analogy in commercial procedure” special attention is paid to the similarity of legal relations as a key condition for applying statutory analogy. The study shows that the approach of assessing similarity based solely on content, subject, and object criteria is formalistic and insufficient if these criteria are simply asserted without explanation.
